You have the right to tell your vet your thoughts. They have the right to refuse treatment. If you want a vet to do it sooner then you need to find another vet but I don't think that will be easy to find for an erstwhile Tom with only one testicle descended.
There is quite a difference between 9 and 26 weeks. I'm not familiar with you on here but, that being the case, I am not even sure why you are in possession of a kitten at 9 weeks old that you want to neuter against veterinary advice.
I hope someone will come along shortly and clarify for me because currently I am quite alarmed.
